Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Blunt ("we," "us," or "our") governing your access to and use of the Blunt mobile application and web platform (collectively, the "App").

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the App.

Eligibility

Age Requirements

You must be at least 13 years of age to use Blunt. If you are between 13 and 18 years old (or the age of legal majority in your jurisdiction), you represent that you have reviewed these Terms with your parent or legal guardian and that they have agreed to these Terms on your behalf.

By using the App, you represent and warrant that you meet these age requirements.

Account Registration

To use Blunt, you must:

• Create an account by providing accurate and complete information
• Maintain the security of your account credentials
• Promptly update your account information if it changes
• Accept full responsibility for all activities that occur under your account

You may not:

• Create an account using false or misleading information
• Create multiple accounts
• Share your account with others
• Use another person's account without permission

Description of Service

Blunt is a platform that allows users to discover public sentiment and opinions on various topics by:

• Capturing or uploading photos to search for related opinions
• Searching for topics through text queries
• Viewing aggregated sentiment data from web sources and AI analysis
• Sharing their own opinions with other users

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without notice.

User Content and Conduct

Your Content

When you upload photos, post opinions, or submit other content to Blunt ("User Content"), you:

• Retain ownership of your User Content
• Grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, distribute, display, and analyze your User Content for the purpose of operating and improving the App
• Represent that you own or have the necessary rights to the User Content
• Represent that your User Content does not violate any third-party rights or applicable laws

Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Upload or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or racially or ethnically offensive
• Upload content depicting minors in any inappropriate context
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Transmit any viruses, malware, or other malicious code
• Attempt to gain unauthorized access to the App or related systems
• Interfere with or disrupt the App or servers
• Use the App for any commercial purpose without our express written permission
• Scrape, harvest, or collect information about other users
• Use automated systems (bots, scrapers) to access the App
• Reverse engineer, decompile, or disassemble any aspect of the App
• Remove or modify any copyright, trademark, or proprietary notices

Content Moderation

We reserve the right, but have no obligation, to:

• Monitor User Content
• Remove or refuse to post any User Content for any reason
• Terminate or suspend accounts that violate these Terms
• Cooperate with law enforcement authorities

Intellectual Property Rights

Our Property

The App and its original content, features, and functionality (excluding User Content) are owned by Blunt and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used without our prior written permission.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes in accordance with these Terms.

Third-Party Services and Content

Third-Party Services

The App uses third-party services including:

• Firebase for database, authentication, and storage
• OpenAI, Google Gemini, Llama (via Groq), and other AI services
• Future advertising networks
• Various APIs and data sources

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of these third-party services.

Third-Party Content

The App displays sentiment data and opinions aggregated from various web sources and AI analysis. We do not endorse or verify the accuracy of this third-party content. You access and use such content at your own risk.

Advertising

We may display advertisements within the App. Advertisers are responsible for ensuring their ads comply with applicable laws. We are not responsible for the content of advertisements or the products or services advertised.

Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

Disclaimers

"As Is" Service

The app is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or security.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected
• The App will meet your requirements

Sentiment Accuracy

The sentiment data and opinions displayed in the App are aggregated from various sources and analyzed using AI technology. We do not guarantee the accuracy, completeness, or reliability of this information. You should not rely solely on this information for making important decisions.

User Content

We do not endorse, support, represent, or guarantee the truthfulness, accuracy, or reliability of any User Content. You acknowledge that any reliance on User Content is at your own risk.

Limitation of Liability

To the maximum extent permitted by law, Blunt, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the App
• Any conduct or content of any third party on the App
• Any User Content
• Unauthorized access, use, or alteration of your content or data
• Any other matter relating to the App

Our total liability to you for any claims arising from or related to the app shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred US dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Blunt and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your User Content
• Any harm caused to other users through your actions

Termination

By You

You may terminate your account at any time through the App settings or by contacting us at hey@blunt.so.

By Us

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• At our sole discretion

Upon termination:

• Your right to use the App will immediately cease
• We may delete your account and User Content
• Provisions of these Terms that by their nature should survive will survive termination

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.

Arbitration

Any dispute arising from or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the Dubai International Arbitration Centre (DIAC), rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Exceptions

Either party may bring a lawsuit in court solely for injunctive relief to stop unauthorized use or abuse of the App or infringement of intellectual property rights.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blunt regarding the App and supersede all prior agreements.

Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the App
• Updating the "Last Updated" date
• Sending an email notification (for significant changes)

Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms without restriction.

Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, or strikes.

Language

These Terms may be translated into other languages for your convenience. In the event of any conflict between the English version and a translated version, the English version shall prevail.
